Anyways, the problem now is we will soon be in a situation where you need control fo the Senate and the White House to get a nominee approved to the court.

There is no way the Democratic Senate will allow any Republican president to appoint a justice to the court at any point in the election cycle. And the way the Republican party tends to take offense at anything that it does to offend others, it's likely that the Republican Senate will probably do the same thing, citing their own actions as justification basically.

Like William Brennan said it's just politics. But it wasn't always this way.
