Question:
I know who Chris is and knows that he doesn't exactly do his photography with a point-and-shoot camera like I do (heck most of my pictures are with my iPhone, and like Chris I do take a lot of transit-related photos, but I've never been questioned about it even in other cities.)
Since the previously mentioned website of the transit agency clearly stated "non-commercial" photography is permitted without a permit, could it be that Chris' choice of camera may have drawn attention to him - rightly, or wrongly? (Somehow I think a terrorist would be less conspicuous and use more common cameras rather than nice SLRs with professional tripods...)
I know of many public venues where while photography is very well permitted, the use of a commercial camera will definitely raise suspicion and cause you to be questioned. One such location is Portland's Pioneer Courthouse Square - that big public park in downtown Portland also known as "Portland's Living Room"; I have heard that the set-up of a tripod anywhere in the park, including the sidewalks bordering the park (described as "curb to curb") is prohibited without a permit. Again, not agreeing that it's right or wrong, just saying that's what I've seen...
