OK - If MIRS is providing service to more than one customer, doesn't that make them a common carrier? If they or Lenare have common carrier authority/responsibility, then this is an abandonment that the STB would have to approve. Lenare could throw them out, but would still have to provide service or apply for abandonment. Even if MIRS has the authority, then Lenare would at least have to file for an adverse abandonment.

Looks like this has been argued before [www.stb.dot.gov]
But there was only one customer at that time and they were not given common carrier authority. This will be a mess for someone.
