What I know about this situation comes mainly from this website (though not entirely from this thread). But from what's been shown here (especially that City document) and stated before, this probably is not a common carrier setup. Only a lawyer (and ultimately a judge or a Federal agency with 3 initials) can say for sure.
It's quite possible to have extensive track connected to the railroad system that's operated for industrial purposes as a non-common carrier. The downside to that is that if the owner of the property wants the line gone nothing much can be done about it by 3rd (or 4th or 5th or...) parties. Now if some of the industrial tenants on the island (Alsthom?) have a problem with it they might have their lawyers discuss things with the rail service provider and Lennar - but that's up to them.
BTW, chez Google, quite a bit of track on the Island has already been cut off by removing key sections - usually switches. I can't see more than maybe 1/2 dozen buildings (don't know which is Alsthom) that still have probably usable rail access. Even the old shipyard area seems to be pretty much cut off though if necessary it might still be possible to clear junk away from some track to get there.
Interesting (off the Island): I don't know how old the Google satellite views are (wish they had dates), but the line through town to some docks near the south end still seems to be in place in those shots. I don't see obvious evidence in the sat pics of active customers. Any locals know what's going on down there if anything?
