Fatigue, though important, was not a factor in this accident. The NTSB doesn't have the latitude to editorialize outside the causal factors of the accident. He wasn't drifting in and out, and his ability to blow the horn for the grade crossings immediately before the accident clearly show he wasn't drowsing.
Sanchez obsesively text messaged while on duty. The timeline clearly shows he was likely texting when he blew past that red signal.
NTSB meticulously collated a whole lot of facts, and those facts all point one way. No one was whitewashing anything. He was paying attention to his texting, not on the operation of his train. End of story.
BTW-have you read the messages which had appeared in the NTSB docket? Taken as whole, they are horrifying in the picture they paint of dereliction of duty.
