Common sense should prevail in this type of thing. Yes, it's private property. Yes, it's trespassing. Yes, the railroad has every right to conduct normal business on their own property. Yes, yes, yes, to all of those things and more!
However......common sense dictates that the majority of those in the crowd are not foamers. The majority in that crowd have probably never even been that close to a train in their entire life.
The solution? Well, for unique circumstances like this, BNSF should either:
1) Wait to move the train until the huge crowds are gone and have crossed the tracks,
OR
2) Pay the City of San Diego PD to have overtime officers monitor that area IF the railroad insists on conducting business and not waiting for the crowds to die down. (Forget hiring private security....that would be useless in my opinion).
As I said, I realize all of the legal rights that the railroad has and to "Get out of my damn way---don't you hear my horn???!!!". But there are situations where administrators have to think outside the box. I think this is one of those situations.
