But I don't think I would be inclined to characterize an "experienced train operator" who had been promoted out of the rank and file to a management position, as "non-union". At BART, the underlying NLRB order governing BART's recognition of its unions, requires that a "withdrawal" be taken when that happens.
Also, I would not grouse very much about anyone willing to take such a promotion into the heat of hell's kitchen, even if it is out of the union. In fact, I would offer them my condolences! Those lower level management jobs, just above union positions, are mostly just plain miserable. Just as miserable at BART as they are on any other railroad. Besides, if it is the fellow I think it is, he is a reasonable and just and fair man - he doesn't deserve the agony he will experience, any more than those killed deserved their fate.
And I do not believe this accident is the result of willful negligence on the part of any specific individuals, but is more systemic - as in faulty rules and procedures. Besides, more important than who is held accountable, is that BART management finally comes to clarity over the real reasons these things happen, and adjust the rules and procedures in the right direction to prevent them.
I personally suspect that would involve bringing those procedures and rules more into line with the rest of railroad industry experience and practice, especially those governing work areas. After all, the laws of physics and the practicalities involved, are the same, regardless of who owns the rails.
