Interesting reading so far. Doesn't SMART need to meet FRA standards, and also recognize the STB mandate given to NWP/NCRA to move commerce?.

It would seem to my feeble mind that the interstate commerce laws would dictate that the facilities be returned to support transport.

As to the letter, looks like someone is following a planned route to a law suit which will get settled before any agency gets its reputation soiled, and if not settled all the ground work is set for Federal Court.
