You may be correct, but I would think after reading correspondence that those were the 12 new shippers, the existing ones would be covered.
It would appear that once they got into the construction, they determined that they could not afford to install swtiches that met the FRA requirements due to the passenger rail service, and that they did not take freight service into account.
Now they are facing a funding short fall, and political situation that they cannot find a way out of, so they punt (do nothing and see if someone notices).
In the end they will be required to at least restore what was in place before they started construction (my opinion). For the new shippers who knows.
