Sammie is largely correct, and this will be part of the basis for any challenge, where any existing connection was actually removed and not restored. Restoration of switches previously removed (which has clouded this issue, but might also be a good idea) is not covered.
Now, as to the cost of a new switch to "reconnect, how about talking to UP about a new switch or a "reconnect"?
It is my understanding that in some cases (with derails, signals, etc. required after Boston) you may be talking well over $1 million for a new mainline switch or reconnect (if they will even talk to you, or offer to give you a switching movement, at all?)?
And, just what does just a (EVIL BART MANDATED???) 115 lb. rail replacement switch assembly alone cost these days?
So is it a conspiracy to shake down poor shippers, or just a real cost of railroading, in todays real dollars? And, should the local taxpayers just provide this to the shippers for free?
The real solution is to find the dollars to pay for these "reconnects". And, we do have FRA short line money available for these types of additions and improvements. But, that may take a bit of serious work to apply for those funds, and would require some political support in Washington.
Back on earth here, choo-choo trains can be a very expensive hobby, especially when you are playing with the big ones.
