Mike, I know you're out of the loop on the legal case. You're thinking
that this is a slam dunk; that the judge will rubber stamp the agreement.

Maybe you're right. But, if you haven't figured it out yet,
NCRA legal counsel Chris Neary has been wrong almost from the
start. He claimed an EIR wasn't required. He claimed the statute
of limitations had passed. He has claimed at NCRA Board meetings that this was
a done deal almost a year ago. He has lost in court and in appeal.
It has cost John Williams dearly. Now, another delay has occurred,
pushing off CTC funding for the track repair project until December,
at the earliest.

The consent decree should be posted to Novato's website. You ought to
read it. There is some language in it that only a lawyer can decipher as to its legality.
(Not my area of expertise.) Let's just say that this language may be
not be acceptable to the judge. We'll find out next week.

We'll also find out whether your favorite passenger rail measure
passes. I kind of doubt it, but it's up to the voters.
