I agree with Little Lake Listener. It is the source of the dollars and not the ownership of the ROW that generates the CEQA requirements.

There are no dollars associated with freight operations. So, why is the NCRA
doing an EIR on freight operations?

To Mike Pechner:

What will SMART do after losing Measure Q? Have you ever seen a public agency return
money to the state? They've got $28 million in the bank. They've just signed multiple
contracts with consultants to continue the engineering.

What would be the scenario for SMART to close down? I don't see it and I'm certainly
not buying the hype that "this is it."
