The city of Novato settled a lawsuit with the NCRA over provisions of the freight deal in October. Trains will run through Novato at approximately 40 mph on no more than six one-way trips per week during daytime hours only. The same tracks eventually will be used by Sonoma Marin Area Rail Transit passenger trains
This sets a bad precedent. Now, cities and towns all around the country will file lawsuits and cite this ruling as a reason for them to restrict train movements through their towns.
It's highly unlikely, but this agreement could put a crimp in NCRA's operations if freight traffic were to develop and increase -- such as a contract hauling garbage and trains running to/from Eureka (when Eureka becomes the SuperPort that's in some people's pipe dreams).
