For all practical purposes, the NWP was NOT an operational railroad UNTIL after EO21 was lifted...previous to that it was an industrial operation protected by derail(s) at the interchange with the CNFR.

Merely the operation of work trains or m of w equipment does not make it a "railroad" until regulatory authorization is granted to operate it as such. So long as the FRA order was in effect, authorization HAD NOT been granted and no common carrier (i.e. "railroad") operations could be conducted.
