The Times confirmed the fact that the truck drove through lowered gates. Ag trucks are often considered "exempt" trucks (meaning it's okay to hire any idiot to drive them), so don't look for a commercial big rig license, or any driver's license at all, in many cases. Also look for no brakes and/or other failures common in "Ag" big rig truck accidents, due to lack of inspections.

I sure hope Amtrak and the State sues the employer for negligence, for recovery of damages to the taxpayers, like Metrolink did with the Studio Truck accident.
