The latest news reports are that the driver said he did not see the train and crossing gates. CHP says he was not impaired.

He might possibly have suffered from micro-sleep that is a medically recognized condition. Micro-sleep can occur even when a person is well rested. It can affect a person who is standing with eyes open wide. It can explain a number of asleep at the wheel crashes.
