Whoa, not quite so fast, Mr. Pechner. One correction. The STB's federal preemption authority is available only to common carriers. The NCRA is not a common carrier. Yes, it owns the underlying rail property, but operating authority is vested solely in NWP, Inc. on the South End and in the NWPY on the North End. That might explain NCRA's failure to appeal denial of their application for a writ to federal court or the STB. Or Mr. Williams may not want to waste his money and/or credibility at this point in the charade. Let's all wait and see what happens when the lawsuit is heard.
